The Latest Update

At the last meeting on April 19th, 934 signatures of Clayton Residents were presented to Mayor and City Council. As of May 31st we have over 1000 signatures and growing. It is crucial that you keep your voices heard as they are reviewing options that could impact you, as a homeowner. On April 19th, the City Council directed the City Attorney to explore all of the legal issues involved in implementation of the ordinance as it is written. To date there has been no meeting scheduled.

As a resident of Clayton you, your neighbors and friends may be adversely affected by a new level of enforcement of the Business License Law that has been in the Clayton Municipal Code since 1978.

The City of Clayton has hired an outside company to provide enforcement of its Business License Fees. This company, however, appears to have taken the position that the law, as written in 1978, allows the City to collect these license fees from a much wider population than the City’s original focus.

This "wider" population could include individuals who have businesses in their homes or even those who simply work from home for companies outside the City of Clayton. It could include business people who come into the City of Clayton to do business even though their home office, plant, shop or store is outside of Clayton.

More importantly, they are now considering charging this Business License Fee not only for this year, but also for the previous three (3) years - even discussing imposing penalties. The amount assessed would be substantial.

You need to act now to avoid putting the City of Clayton
at a competitive disadvantage. Let your neighbors, clients and friends know that your City Council is considering this issue at its next meeting. They need to know everyone will be affected and, more importantly, they need to know what you think is appropriate and fair.

We need your help to avoid the negative effects these fees will have on our local businesses, our city residents, and even our property values!
 
The imposition of these types of fees and potential penalties sends a signal that the city is not business friendly - making it harder to attract new jobs.
   

Because these fees can apply to individuals who do
not live in the city, but provide services to city residents, the new fees could impact property values. If Realtors® see these fees as onerous, they will avoid showing their prospects houses in Clayton - making it harder to sell your home and thus lowering property values.

   

By contracting with a private company for collection of these fees, our elected officials are no longer directly responsible for who or how these fees are imposed. The people no longer have elective oversight.
